हम में से अधिकांश शिक्षक अभी तक शिक्षक सेवा नियमावली 1981 के 12 वां/15वां/16वां संशोधन के फेर से अनभिज्ञ हैं या अनभिज्ञ है। हमने हिंदी और आंग्ल भाषा में तीनों संशोधनों के मुख्य बिंदुओं को इस पोस्ट में लिखा है।
हमारा इसके पीछे निहित एकमात्र उद्देश्य यह है कि आप सभी इस मुद्दे से अवग़त हों कि उच्च न्यायालय ने 15 वां और 16 वां संशोधन रद्द करते हुए, बेस ऑफ़ सेलेक्शन, NCTE की शक्तियां, टेट मेरिट को भारांक आदि मुद्दे पर अंतिम निर्णय के लिए सुप्रीम कोर्ट भेज दिया है। इस मुद्दे पर मजबूती हमारी अकेडमिक भर्तियोँ का पक्ष रखना जरुरी हो गया है।
12th amendment】(बारहवां संशोधन)
Clause 8 was amended with addition of TET Exam इस संशोधन में टेट परीक्षा को समाहित किया गया।
Clause 14 - specifically Clause14(3) which decide the preparation of merit list for appointment of teachers, this clause was amended with the extent that from date amendment system of priority of batches was closed and new merit list for appointment of teachers will now be prepared on basis of marks obtained in TET Exam which in turn means that all BTC holders, Special BTC holders and Urdu BTC holders who are TET pass will now be selected on basis of merit prepared on marks obtained in TET Exam.
इस संशोधन में मुख्यतः 14(3) जो शिक्षकों की नियुक्ति के लिए मेरिट लिस्ट तैयार करने का नियम तय करता है, से बैच वरीयता के नियम को हटाकर टेट मेरिट के आधार पर वरीयता सूची बनाने का नियम लाया गया, इसका मतलब सभी बीटीसी, उर्दू बीटीसी, स्पेशल बीटीसी को टेट के प्राप्तांक के आधार पर नियुक्त किया जायेगा।
【15TH AMENDMENT】(15 वां संशोधन)
In this amendment Clause 14(3) was amended accordingly selection merit was to be prepared on quality points (10% of X, 20% of XII, 40% of Graduation and 12,6,3 of for training like BTC /B.ed). In Clause CTET was added along with UPTET for BTC/SBTC/UrduBTC.
(इस संशोधन में 14(3) संशोधित करके btc/sbtc/urdubtc को एकेडमिक क्वालिटी पॉइंट 10%,20%,40% +12/6/3 के आधार पर नियुक्ति देने का नियम बना, और टेट/सीटेट को केवल अर्हता माना गया।
【16th AMENDMENT】( सोलहवां संशोधन)
In this amendment new clause 2(a) was added defining Trainee teachers which is as follows---
इसमें प्रशिक्षु शिक्षक को परिभाषित करते हुए टेट उत्तीर्ण बीएड/बीपीएड(विशेष)/डीएड(विशेष) को ट्रेनी टीचर कहा गया, जिन्हें विशेष प्रशिक्षण के बाद जूनियर बेसिक स्कूल में नियुक्ति दी जायेगी) all B.ed/B.ed(sp education)/D.Ed(sp Ed.) passed and have also passed TET will be called trainee teachers. They after special training in elementary education program recognized by NCTE will be appointed in Junior basic schools.
In this amendment Clause 14(1) is divided into three parts इस संशोधन में 14(1) को तीन भाग में बांटा गया है।
14(1)(A)—advertisement for BTC/SBTC/Urdu BTC as per clause 5(A)(बीटीसी/विबीटीसी/उर्दू बीटीसी का विज्ञापन।
14(1)(B) advertisement for trainee teachers for B.Ed(प्रशिक्षु शिक्षक का विज्ञापन)
14(1)(C ) Advertisement for appointment in Assistant teachers to B.Ed candidates after getting elementary training course from NCTE recognized( प्रशिक्षु शिक्षक की ट्रेनिंग के बाद नियुक्ति का विज्ञापन)
●Now 14(3) which again gets divided into 3 parts 14(3) को तीन पार्ट में बांटा गया है।
14(3)(A)BTC/SBTC/UrduBTC and senior basic teachers will be selected with academic points and as per 12,6,3 standard which is under 15th amendment
●14(3)A● के आधार पर BTC/URDU btc/sbtc को प्राथमिक में और उच्च प्राथमिक में एकेडमिक क्वालिटी पॉइंट के आधार पर नियुक्त करने का नियम है।【इसी नियम पर हमारी नियुक्ति हुई है】
●Since 14(3) of 15th amendment is struck down and here in 16th amendment clause 14(3)(A) is nothing but Xerox of clause 14(3) of 15th amendment, considering this C.J. declared 16th too ultra virus.
●This declaration of 16th amendment as ultra virus implied all work done in 16th were also became inoperative.
चूँकि 15 संशोधन का 14(3) पहले से रद्द है और 16वें संशोधन का 14(3)A उसी 14(3) की कॉपी है इसलिए 1 दिसंबर के आदेश में CJ ने 16 वां संशोधन भी रद्द घोषित कर दिया है।
