It is stated that the petitioner was selected as Trainee Teacher, however,
a show cause notice was issued to him that due to inadvertent mistake the
order for his selection was issued. The petitioner has submitted his reply.
It is submitted that the petitioner has completed six months' training of
the trainee teacher and the examination is likely to be conducted in near
future. The examination is commencing from 16th & 17th November, 2015. It
is stated that in case the petitioner is not permitted to appear in the
examination a serious prejudice would be caused to him, even if the writ
petition is allowed as the time lost will not be reversed.
Learned counsel for the petitioner has drawn the attention of the Court to
an order dated 21st August, 2015 passed in Writ-A No.38648 of 2014 (Ravi
Kant Mishra and another v. State of U.P. & 2 others).
Sri B.P. Singh, learned Advocate has accepted notices on behalf of the
second and seventh respondents. Learned Standing Counsel represents all the
State functionaries.
Having regard to the facts and circumstances of the case a direction is
issued upon the concerned respondents to allow the petitioner provisionally
to appear in the examination. His result shall abide by the result of the
writ petition.
The respondents may file counter affidavit within six weeks. Rejoinder
affidavit, if any, may be filed within a week thereafter.
List after expiry of the aforesaid period.
