Court No. - 7 Case :- WRIT - A No. - 29443 of 2016 Petitioner :- Deepak Kumar Tiwari And 12 Ors. Respondent :- State Of U.P. And 3 Ors. Counsel for Petitioner :- Ram Milan Mishra Counsel for Respondent :- C.S.C.,Bhanu Pratap Singh Hon'ble Manoj Misra,J. A detailed counter-affidavit has been filed by respondents 1 to 3 today, which is taken on record. Learned counsel for the petitioners prays for and is allowed two weeks time to file rejoinder-affidavit. It has been contended on behalf of the respondents that by the interim order dated 28.06.2016, the respondents have been restrained from issuing appointment letters to any of the eligible candidates with a further direction that if appointment letters have been issued then they may not be permitted to join the aforesaid post till the next date of listing. It has been submitted that seven of the petitioners have also been selected and they are being appointed and, therefore, the dispute relates only to remaining six petitioners. Accordingly, there is no justification to keep appointment in abeyance in excess of six posts. It has been submitted that such a blanket ban on appointment would not subserve the objective of Right of Children to Free and Compulsory Education Act, 2009 and, therefore, such a blanket ban may be modified/vacated. Learned counsel for the respondents have informed the Court that there are 400 posts in the District Badaun for which recruitment was being made pursuant to the advertisement dated 12.12.2014/13.12.2014 whereas the petitioners are only 13 in number and, therefore, the interim order may either be made operative in respect of thirteen posts or six posts keeping in mind that seven petitioners have already been selected.
