Heard Mr. Prabhakar Awasthi, learned counsel for the petitioners and Mr. A.K. Goyal, learned Additional Chief Standing Counsel for the respondent-State.
The petitioners, who are sixteen in number, have filed the instant writ petition on 10.11.2017 for the following reliefs:
"(i) issue a writ, order or direction in the nature of Mandamus directing the respondent no.1 to inquire the fraud occurred at highest level by the examining body and concerned department in conducting the Teacher Eligibility Test (Primary Level) Examination-2011 and maintaining the record; preparation of tabulation register and unauthorized correction i.e. fabrication of tabulation register through C.B.I. or any independent agency.
(ii) Issue a writ, order or direction in the nature of Mandamus directing the respondents to terminate those teachers who have been appointed on the basis of fraudulent mark-sheets of Teachers Eligibility Test-2011."
It is not in dispute that a Teacher Eligibility Test (Primary Level), under challenge, was conducted sometime in 2011 and on the basis of the result, lakhs of candidates who cleared test, according to the petitioners, were issued certificates by the Board of High School and Intermediate Education, Uttar Pradesh, Allahabad, including the petitioners. The certificate is the minimum eligibility criteria for securing job in primary schools run by the Government as well as the private institutions admitted to grants. The certificate issued in 2011 admittedly was valid for five years, which expired sometime in November, 2016. During this period, counsel for the petitioners submits that the petitioners did not get any job. It is thereafter petitioners are coming before this Court and challenging Teacher Eligibility Test (Primary Level) Examination-2011 after more than six years. It has come on record that� some petitions were filed earlier and this Court passed orders from time to time including for holding enquiries. Keeping that in view and considering the submission of counsel for the petitioners that enquiries are still in progress, we would not like to entertain this petition. In any case, we are not inclined to examine the challenge, at the instance of the petitioners who after having lost all hopes to secure job on the basis of the certificate, approached this Court at such a belated stage. The petition, in our opinion, deserves to be dismissed at the threshold. Order accordingly.
