The petitioner is a candidate for appointment on the post of Assistant
Teacher in Science and Mathematics. It is contended on behalf of the
petitioner that during the third counseling the cut off marks of the
general category candidates in the subject of Mathematics was 67.25 and in
Science it was 69.02. According to the petitioner, her cut off marks is
above the said marks.
On 15th October, 2015 learned counsel for the respondents was granted time
to seek instructions in the matter.
Learned counsel for the District Basic Education Officer has received the
instructions, which he has produced before the Court and is taken on
record.
The District Basic Education Officer is directed to file a counter
affidavit, which will be sworn by the officer, who has sent the
instructions.
As prayed by the learned counsel for the District Basic Education Officer,
two weeks' time is granted to file a counter affidavit. Rejoinder
affidavit, if any, may be filed within three days thereafter.
List this case on 27th November, 2015.
Learned counsel for the petitioner has drawn the attention of the Court to
an order dated 10th February, 2015 passed by this Court in Writ-A No. 5001
of 2015, Vivek Kumar Upadhyay and others v. State of U.P. and others,
wherein following direction has been issued:
"In view of the position that the petitioners have appeared in the first,
second and third counseling and possess 70% in general category and 65% in
reserved category, the petitioners have a prima facie right to be appointed
against the post of Assistant Teacher in the districts in which they have
applied and appeared in counseling as per their merit. A case for grant of
interim mandamus is made out by the learned counsel for
the petitioner."
In view of the above, it is provided that till the next date of listing one
post of the Assistant Teacher in Science and Mathematics shall be kept
reserved for the petitioner.
