Grievance Description : Honourable Sir, This is to inform you about illegal and unconstitutional appointments of teachers in recruitment of 72825 Primary Assistant Teachers (2011) in Uttar Pradesh. Hardoi DIET called me for 3 counselings on 12.11.2014, 10.01.2015 and 13.07.2016 for recruitment as Assistant Primary Teacher. But appointment letter has not been given till date. DIET has appointed reserved category selected candidates (already appointed and getting salaries and incentives) on the vacant seats of non-reserved candidates in the name of reshuffling. It appears that the BSA has given the appointments to OBC candidates in large number by shifting already selected OBC candidates to the General Male Art vacant seats. Hence, the cut off for general candidates has not gone lower than 116. After the selection of overall 30,000 candidates in the state, the cut off was 116 and after the selection of 64,000 candidates, the cut off is still at 116. Although, only 318 candidates of Gen Male Arts got 116 marks, and out of them 88 candidates are waiting for their appointments till date. By proper scrutiny the fact was found that the Higher Authority Basic Education Secretary Lucknow has released instructions for BSA to reshuffle the selected candidates on the vacant posts of General Male category candidates. Vertical reservation for reserved category candidates is provided in the laws of reservation U/s 16(4), but illegally, the horizontal reservation (which is provided for only Handicapped and army men) has been provided to the "Selected OBC candidates". This is against the reservation laws and natural justice for general category candidates. Moreover, data of all selected candidates has not been filtered at any stage and already appointed and selected candidates are called again and again for counselling with photo copied documents. Because of adopting this method on every stage of appointment again and again, it became impossible for General Male Candidates to get the appointment letter till date. On the other hand, huge number of OBC candidates has been appointed on the seats for General category candidates by giving them double benefits of reservation in an illegal way. The cut off is declared categorywise, the counseling is done categorywise, but neither the apointment letters are distributed categorywise nor the data is prepared categorywise. Due to grab of reshuffling, the reserved candidates who have already been selected, appointed and those who are already getting their salary on their posts, are again and again shifted on the posts of general category candidates and general candidates are still waiting for appointment. In this way, more than 75% seats have been filled by reserved category candidates and appointment letters have been issued to them in Hardoi D.I.E.T., which is an illegal and unconstitutional job done by the BSA. This is also against the reservation policies. So please do the needful to provide natural justice for General Candidates so that we, the general category candidates could also get our appointments. Prayer Respected Sir, you hereby humbly requested to look into the matter and provide help to me in getting the appointment letter, which is used to be received by before 24 months from date.
