Heard learned counsel for the petitioner. Learned Standing counsel appears for respondents no. 1,2 and 4. Sri Rajiv Singh Chauhan, learned counsel appears for respondents no. 3 and 5.
The dispute in the present writ petition relates to the appointment on the post of Assistant Teacher, Junior Basic School run by Basic Shiksha Parishad, U.P., pursuant to the advertisement dated 30.11.2011.
The petitioner is qualified and eligible for appointment and has obtained more than 70% marks in TET Examination-2011 and is entitle to be considered for appointment pursuant to the directions of the Supreme Court.
The submission of learned counsel for the petitioner is that despite the petitioner being selected in the second round of counselling for district Sitapur she has not been given appointment letter as yet.
A similar writ petition No. S/S 5001 of 2015 (Vivek Kumar and 29 others Vs. State of U.P. and others) has already been entertained in connection with appointment of Assistant Teachers in Junior Basic School pursuant to the advertisement dated 30.11.2011.
Learned counsel for the respondents are directed to file counter affidavit within three weeks. One week thereafter is allowed to the petitioner to file rejoinder affidavit.
Let this writ petition be connected and listed along with writ petition No. S/S 5001 of 2015 (Vivek Kumar and 29 others Vs. State of U.P. and others) for admission/final disposal on expiry of the aforesaid period.
In the meantime the District Basic Education Officer may consider the issuance of appointment letter to the petitioner on verification of the testimonials by the Principal, District Institute of Education and Training (DIET) and that she has been selected in the second counselling. The appointment of the petitioner, if any, shall be subject to decision of the writ petition.

वर्तमान रिट याचिका में विवाद 2011/11/30 दिनांकित विज्ञापन के अनुसार बेसिक शिक्षा परिषद, उत्तर प्रदेश, द्वारा चलाए सहायक शिक्षक, जूनियर बेसिक स्कूल के पद पर नियुक्ति से संबंधित है।
याचिकाकर्ता योग्य और नियुक्ति के लिए पात्र है और TET परीक्षा-2011 में 70% से अधिक अंक प्राप्त किया है और उच्चतम न्यायालय के निर्देशों के अनुसार नियुक्ति के लिए विचार किया जा समर्थ बनाना है।
याचिकाकर्ता के लिए सीखा वकील प्रस्तुत करने याचिकाकर्ता जिला सीतापुर के लिए परामर्श के दूसरे दौर में चयनित होने के बावजूद वह अभी तक नियुक्ति पत्र नहीं दिया गया है।
इसी प्रकार का एक रिट याचिका संख्या एस / एस 2015 की 5001 (विवेक कुमार और उत्तर प्रदेश और दूसरों के राज्य बनाम 29 अन्य) पहले से ही 2011/11/30 दिनांकित विज्ञापन के अनुसार जूनियर बेसिक स्कूल में सहायक अध्यापकों की नियुक्ति के संबंध में मनोरंजन की गई है।
उत्तरदाताओं के लिए सीखा वकील तीन सप्ताह के भीतर काउंटर हलफनामा दायर करने के लिए निर्देशित कर रहे हैं। एक सप्ताह उसके बाद जवाब शपथ पत्र दायर करने के लिए याचिकाकर्ता की अनुमति दी है।
इस रिट याचिका जुड़ा हुआ है और रिट याचिका संख्या एस / 2015 के एस 5001 (विवेक कुमार और उत्तर प्रदेश और दूसरों के राज्य बनाम 29 अन्य) उक्त अवधि की समाप्ति पर प्रवेश / अंतिम निपटान के लिए साथ साथ सूचीबद्ध किया करते हैं।
इस दौरान जिला बेसिक शिक्षा अधिकारी प्रधानाचार्य द्वारा प्रशंसापत्र के सत्यापन पर याचिकाकर्ता को नियुक्ति पत्र जारी करने, शिक्षा और ट्रेनिंग (डाइट) के जिला संस्थान विचार कर सकते हैं और वह दूसरी काउंसलिंग में चयनित किया गया है। याचिकाकर्ता की नियुक्ति, यदि कोई हो, रिट याचिका के निर्णय के अधीन होगा।
