One of the issues raised in the instant writ petition is whether the impugned advertisement which seeks to make selection on the post of Assistant Teachers in the Basic Schools, run by the Basic Education Parishad, U.P., Allahabad, is valid or not in view of the law laid by the Full Bench of this Court in the case of Shiv Kumar Sharma and others vs. State of U.P. and others 2013 (6) ADJ 310 and the Division Bench judgement in the case of Shiv Kumar Pathak and others vs. State of U.P. and others� 2013 (10) ADJ 21. It is noticeable that in these decisions, this Court has struck down the 15th and 16th Amendments respectively made to the Rules, whereby the selection is to be made on the basis of quality point mark to be calculated as per Appendix 1, having regard to the marks obtained by the candidate in High School, Intermediate, Graduation and Training qualification without giving any weightage to the marks obtained by a candidate in the T.E.T. Examination.� Although by 19th Amendment, Rule 14 has again been amended, but once again the same Appendix 1 which was introduced by 15th Amendment Act has been made the basis for calculating the quality point marks and for making the selection.
In the submission of learned counsel for the petitioner, the same could not be done in view of the authoritative pronouncement by the Full Bench striking down the 15th Amendment, as a result whereof Appendix 1 also does not survive.
Learned Standing Counsel appearing on behalf of respondent no.1 and Sri P.D. Tripathi appearing on behalf of respondent no.2 and 3 pray for and are granted a week's time to obtain instructions in the matter or to file counter affidavit, if any.

Sri Seemant Singh, learned counsel who has filed impleadment application, has been heard as an intervener. He is also granted time to file counter affidavit, if any within the same period.
List on 23 January 2017.
In the meantime, if any selection is made on the advertised post, the same shall be subject to the decision of the writ petition.
