It is contended on behalf of the petitioner that the petitioner had applied for appointment on the post of Assistant Teacher (Science) in Senior Basic School. She was called for in the fourth round of counselling.
According to the petitioner, her aggregate marks was 76.76, whereas the cut off marks was 76.47. Thus, having aggregate above the cut off marks she was selected. The petitioner has deposited her original documents, however, later on in the subsequent counselling reshuffling has been made without any provision with the result that the petitioner has not been issued appointment letter.
It is stated that similar issue came to be considered by this Court in Writ Petition No. 60202 of 2015 (Sanjay Kumar Sharma and others v. State of U.P. and others), wherein the Court has passed a detailed order on 17th December, 2015 and following direction has been issued:
"Considering the facts and circumstances of the case, a direction is issued to the respondents to issue appointment letter to the petitioners who were selected in the 3rd and 4th round of counselling within 10 days from the date of communication of this order. It would be mentioned in the appointment letter that the selection shall abide by the result of the writ petition."
Learned Standing Counsel appears for the first, second and fifth respondents and Sri Y.S. Bohara, learned Advocate, has accepted notices and put in appearance on behalf of the third and fourth respondents.� They do not dispute the said fact.
They may file counter affidavit within six weeks.
Tag and list this writ petition with Writ-A No. 60202 of 2015.
In the meantime, the interim protection granted in the case of Sanjay Kumar Sharma and others (supra) is extended to the petitioner also.
