इलाहाबाद हाईकोर्ट ने कौशाम्बी जिले के जूनियर हाईस्कूल के सहायक अध्यापकों
व प्राथमिक स्कूल के प्रधानाचार्यो की याचिका को निस्तारित करते हुए बेसिक शिक्षा परिषद उप्र के सचिव को 17140 रुपये वेतनमान पर तीन माह में निर्णय लेने का निर्देश दिया है।
विभिन्न स्कूलों के 44 अध्यापकों व प्रधानाचार्यो को अभी 17060 रुपये का वेतनमान दिया जा रहा है। इनका कहना है कि प्रोन्नति मिलने पर उन्हें न्यूनतम वेतनमान पाने का पूरा हक है। यह आदेश न्यायमूर्ति बी अमित स्थालेकर ने संतोष कुमार सिंह व 43 अन्य की याचिका पर दिया है। याचिका पर अधिवक्ता अनूप पांडेय व राधेकृष्ण पांडेय तथा विपक्षी अधिवक्ता पीडी त्रिपाठी ने बहस की।
याची का कहना है कि 24 जनवरी 2009 के आदेश से प्राइमरी स्कूल के प्रधानाचार्य व जूनियर हाईस्कूल के सहायक अध्यापकों को एक समान वेतनमान दिया जाए, किंतु इसकी अनदेखी की जा रही है। कोर्ट ने सचिव बेसिक शिक्षा परिषद को तीन माह में निर्णय लेने का आदेश दिया है।

Heard Shri Radhey Krishna Pandey, learned counsel for the petitioner and Shri P.D. Tripathi, learned counsel appearing for the respondents no. 3,4 and 5 and Shri K.R. Singh, learned standing counsel for the respondents no. 1 and 2.
The petitioners, who are 44 in number, are seeking a direction to the respondents to pay salary as basic pay of Rs.17,140. According to the petitioners by an order dated 24.1.2009 a decision has been taken that the Head Masters of the Primary and Assistant Teachers Grade III of Upper Primary Schools will be entitled to the pay scale of Rs.17,140/- with Grade Pay of Rs.4600/- by way of amendment, at page 77 of the writ petition. However, from page 96 of the writ petition it has been disclosed that the petitioners are getting salary of only Rs.17,060/-.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction to the respondent no. 3-Sachiv Basic Shiksha Parishad, U.P. Lucknow to examine the claim of the petitioners and take a decision in this regard in accordance with law within a period of three months from the date of receipt of the certified copy of this order.
It is made clear that the Court has not adjudicated the claim of the petitioners on merit.
