विषय :- माननीय सर्वोच्य न्यायालय में योजित CA4347-4375/2014 में हुए आदेशों के अनुपालन के सम्बन्ध में प्रार्थना पत्र।
महोदय,
विनम्र निवेदन के साथ माननीय सर्वोच्य न्यायालय में योजित याचिका CA4347-4375/2014 State Of UP & Ors Vrs Shiv Kumar Pathak & Ors पर हुए आदेशों के अनुपालन हेतु कुछ तथ्यों से आपको अवगत कराना है जो निम्नवत है....
महोदय "प्रशिक्षु शिक्षक चयन 2011" के चयन आधार के विवाद के निस्तारण हेतु वाद पहले उच्य न्यायालय इलाहाबाद में विचाराधीन रहा तदोपरांत वाद उच्यतम न्यायालय में विचाराधीन हुआ। पूर्ववर्ती सरकार की गलत नीतियों के कारण उच्यतम न्यायालय के आदेशों का अनुपालन न्याय संगत नही किया गया इस कारण हम आपके समक्ष न्याय हेतु बड़ी उम्मीद के साथ खड़े हुए है।
माननीय उच्यतम न्यायालय ने दिनाँक 7दिसम्बर2015 को सुनवाई के दौरान आदेश पारित किया "At this juncture, Mr. Rakesh Dwivedi, learned senior counsel,Mr. Neeraj Jain, Mr. Siddharth Dave, Mr. Sanjay Hegde, Mr. VikasSingh, Mr. Anand Nandan, Mr. Arvind Srivastava, Mr. Ajay Jain, Ms.Rachana Shrivastava, Mr. Avnish Singh, Mr. D.K. Tiwary, Mr. RajivDubey, Ms. S. Janani, Mr. Ashok Kuamr Sharma and Mr. Manoj Prasadlearned counsel submit that they represent approximately 1100people and some arrangement should be made for them. On beingasked, Mr. Vijay Bahadur Singh, learned Advocate General submittedthat the State has no objection to offer them appointment on ad hocbasis subject to result of the special leave petitions. Let thatbe done within four weeks hence. Needless to say, no right shallaccrue in their favour because of this order." इस आदेश के अनुपालन में पूर्ववर्ती सरकार ने 1100 अभ्यर्थियों के सापेक्ष 841 याची अभ्यर्थियों को एडहॉक नियुक्ति प्रदान की।
महोदय अगली सुनवाई अर्थात 24फरबरी2016 सुनवाई के दौरान माननीय उच्यतम न्यायालय ने पुनः आदेश पारित किया "Registry is directed to register all the interlocutoryapplications filed in the appeals, special leave petitions or writpetitions. In these interlocutory applications, the grievancewhich has been canvassed is issue that though they stand on thesimilar footing with the applicants which have been granted thebenefit by the previous order dated 07.12.2015, the State has notconsidered their cases.
Let copies of the interlocutory applications be served on Mr.Gaurav Bhatia within a week hence. It is directed that the Stateshall consider the applicants in the said interlocutoryapplications or the names that find place in the said interlocutory applications on the parameters which were fixed on the lastoccasion. The said exercise shall be completed within ten weeks hence.
We will be failing in our duty, if we do not note thegrievance made by various parties who have filed differentinterlocutory applications, special leave petitions and writpetitions before this Court. Additionally, there is a grievancethat parties who are respondents in the civil appeals or thespecial leave petitions have not been considered for some technicalreason or the other. Regard being had to the same, we permit thelearned counsel appearing for the applicants in the interlocutoryapplications petitioners/respondents in the writ petitions, specialleave petitions or civil appeals to give their respective lists toMr. Gaurav Bhatia within a week hence. The interlocutory applications, writ petitions, special leave petitions or civilappeals which have been filed till today and have been directed tobe registered shall only be considered by the State and the namesof the respondents in the special leave petitions or the civilappeals shall be considered for the present.
The competent authority of the State Government shall considertheir cases individually on the parameters of the last order andsubmit a report. The report shall indicate the marks obtained byeach of the candidates and also shall indicate how many personswould be eligible to be appointed on ad hoc basis." इस आदेश के अनुपालन हेतु हमारे एडवोकेट्स ने सभी फाइल्स को सरकारी एडवोकेट श्री गौरब भाटिया जी को एक सप्ताह में रिसीव कराया जिस पर सरकार को दस सप्ताह में पूर्व के आदेश के आधार पर ही पूरी प्रक्रिया को सम्पन्न करना था लेकिन पूर्ववर्ती सरकार द्वारा यह कार्य पूर्ण नही किया गया।
महोदय इसके पश्चात 24अगस्त2016 को माननीय उच्यतम न्यायालय ने पुनः आदेश पारित किया कि "This Court on 7.12.2015 and 24.2.2016 had passed certaininterim orders. Learned counsel for the petitioners, who are thebeneficiaries of the said orders, have raised the grievance thatthe orders passed by this Court have not yet been complied with bythe State.
Mr. Dinesh Dwivedi, learned senior counsel shall file anaffidavit of the competent authority, preferably the Secretary ofthe Department concerned, how they are going to comply with them oris there any real difficulty in complying with them. Be itclarified, the stand of the State shall be addressed only at thetime of final hearing.
Be it stated, in course of hearing we have found that a seriesof Interlocutory Applications seeking similar reliefs have beenfiled. Some of the learned counsel appearing for the partiessubmitted that regard being had to the earlier orders, especiallyorder dated 24.2.2016," दुर्भाग्य से सपा सरकार ने पुनः हुए इस आदेश को भी संज्ञान में नही लिया और कोई कार्यवाही हमारे हित में नही की।
महोदय, माननीय उच्यतम न्यायालय ने अगली सुनवाई अर्थात 17नवम्बर 2016 को पुनः सरकार को आदेशित किया कि " If there is anyone who is covered by the interimorder and has not been granted the relief, the StateGovernment shall consider the same in proper perspective bythat time." महोदय इस आदेश का अनुपालन भी पूर्ववर्ती सपा सरकार द्वारा नही किया गया।
महोदय, आज उत्तर प्रदेश में लाखों पद रिक्त है और हम 2011 से योग्यता (बीएड+टी ई टी) पूरी करने व् न्यायालय द्वारा कई बार आदेश होने के बाद भी आज तक न्याय / रोजगार से वंचित है। हमें आशा ही नही वरन पूर्ण विश्वास है कि भाजपा की इस न्यायप्रिय सरकार में हम बीएड टी ई टी उत्तीर्ण याची अभ्यर्थियों को न्याय, रोजगार, सहायक अध्यापक पद का सम्मान अवश्य प्राप्त होगा। हम आपके सैदव आभारी रहेंगे। हिर्दय से आभार
