The petitioner stated to have appeared in the third� round of counseling in� districts Siddhartha Nagar. The petitioner claims that his name appeared in the select list prepared after third round of counseling as his marks were higher than the cut of his category. Despite that appointment letter has not been issued to the petitioner as the candidates having higher marks than that of the petitioner have been allowed to participate in the fourth round of counseling and the entire result has been reshuffled.
Learned Standing counsel appearing for respondent Nos. 1, 2 and 5.� Sri Ashok Kumar Singh, learned counsel has put in appearance on behalf of respondent nos. 3 and 4. They� pray for and are allowed three weeks time to file counter affidavit. The petitioner shall have one week thereafter for filing rejoinder affidavit.
Connect with Writ-A No. 5001 of 2015.
In the meantime, appointment letter be issued to the petitioner by the DIET after verification of his eligibility and after ascertaining the fact of appearance in the counseling as per his merit. It goes without saying that the appointment of the petitioner shall be subject matter of the result of this writ petition and Civil Appeal No. 4347/4375 of 2014 (State of U.P. & others versus Shiv Kumar Pathak) pending before the Apex Court.��
It is made clear that the candidates to whom appointment letters have already been issued, will not be affected by this interim order.
