As per the statement made by Shri Devendra Uppadhaya, learned Additional Chief Standing Counsel, the Principal Secretary, Basic Education is not available today as he has gone to Delhi in connection with filing of S.L.P. before the Hon'ble Supreme Court. However, Deputy Director of Basic Education is present. He states that as per the decision of this Court and the interim orders passed by the Hon'ble Supreme Court in S.L.P. arising out of said judgment the selection and appointment of Assistant Teachers in pursuance to the advertisement of 2011 is to be held on the basis of the merit as assessed on the basis of marks secured by them in the T.E.T. Examination and the Hon'ble Supreme Court has permitted the appointments with respect to the selection in question subject to the result of the S.L.P. As far as the irregularities detected in obtaining the T.E.T. Mark Sheets which have been found in the investigation conducted they were the subject matter of Writ-A No. 48620 of 2015. The directions issued therein for examination of all the OMR/Answer Sheets and identifying the cases where the result of even those candidates had declared who were never present in the examination is concerned, the Court has granted four months time to complete the said exercise vide its judgment dated 08.10.2015 passed in the said writ petition, which has not yet come to an end as of now. The exercise as ordered by this Court is under way. In these circumstances, this Court is not inclined to interfere with the issuance of appointments letter and the same is already subject to the result of the S.L.P. pending in the Supreme Court, however, as far as irregularities in the T.E.T. Examination are concerned, the concerned authority shall comply with the direction of this Court dated 08.10.2015 passed in Writ-A No. 48620 of 2015 and take consequential action within the time stipulated in the said judgment. A copy of the said report shall be filed along with their counter affidavit in this writ petition within a period of three weeks from the expiry of the period of four months as ordered in the judgment dated 08.10.2015. Issue notice to opposite parties no. 6 and 7 returnable at an early date. List this case in the second week of March, 2016. Needles to day that the appointments made shall be subject to the aforesaid exercise and the result of this writ petition also. The Officers ordered to appear need not appear unless called.
