सफेदा मामले का 5 तारीख वाला फाइनल आदेश आ चुका है , कोर्ट
ने साफ़ कहा है कि यदि इन दो अभ्यर्थियों ने अपनी omr sheets पर सफेदा या
ब्लेड आदि use किया है , और उन प्रश्नों का मूल्यांकन किया है तो ही इनको
चयन से बाहर किया जाये !
साथ ही 2012 की उस्मानी कमेटी की रिपोर्ट से साफ़ हुआ है कि केवल 74 omr sheets पर ही सफेदा लगा मिला था !

Heard Shri Seemant Singh, learned counsel for the petitioners, Shri Mirigraj Singh, learned counsel for respondent No. 5 and Shri Mata Prasad, learned Additional Chief Standing Counsel for respondents No. 1 to 4.
The allegation of the petitioners in the writ petition is that against the specific instructions regarding the OMR Sheet in the Teachers Eligibility Test (Primary) held on 13th November, 2011, two persons, namely, Sobhit Srivastava and Brijesh Kumar, whose names have been mentioned in paragraph-22 of the writ petition have used whitener.
The petitioners are therefore seeking a direction to the respondents to exclude the candidates, who have used whitener on their OMR Sheets in the aforesaid examination.
An Impleadment Application No. 336320 of 2015 dated 11.9.2015 has been filed for impleadment of Sobhit Srivastava and Brijesh Kumar as respondents No. 6 and 7 in the writ petition.
It has been pointed out by the learned counsel for the petitioners that the matter regarding irregularities in the selection in question was ordered and an enquiry report has been submited by the Chief Secretary dated 10.4.2012, in which wide scale irregularities have been reported and it has been mentioned that on examination of random OMR Sheets it was found that in #74 OMR Sheets whitener was used and in about 3493 OMR Sheets carbon was used.
It has also been noted that the Agency which conducted the examination admitted that it had acted under the pressure and command of the Board of Secondary Education and in some cases even second carbon copy has been used.
Learned counsel for the respondents have no objection to the impleadment application.
Accordingly, the impleadment application No. 336320 of 2015 is allowed.
Let Sobhit Srivastava and Brijesh Kumar be impleaded as respondents No. 6 and 7 in the array of respondents today in the Court itself.
It is informed that in view of the mass scale use of whitener in the selection in question, the matter is being investigated and criminal matter is also pending.
Therefore, the writ petition is finally disposed of with the direction to the respondent No. 1, Secretary, Basic Education U.P. Lucknow, to enquire into the matter specially with regard to newly impleaded respondents No. 6 and 7, namely, Sobhit Srivasatava and Brijesh Kumar and examine their OMR Sheets and if it transpires that they have indeed used whitener or scored out their answer by use of blade or otherwise, suitable action shall be taken by the Board.
This exercise shall be completed by the Respondent No. 1 within a period of four months from the date of receipt of a certified copy of the order in his Office.
