The petitioner in this petition purports to challenge the vires of Rule 5(iii) and 5(iv) of U.P. Basic Education (Teacher) Service Rules, 1981as amended by 15th amendment with effect from 31st August, 2012.
Sri Shailendra, learned counsel has put in appearance by filing an application for impleadment on behalf of one Deepak Sharma and contends that the petitioner has no locus standi to maintain this writ petition.
In view of the fact that the cases where vires of Central or State legislation is challenged are reported to be cognizable by the Bench presided over by the Hon'ble The Chief Justice, let this matter by placed before the appropriate Bench as fresh at the earliest.
