Notice on behalf of opposite party no. 1 & 3 has been accepted by learned Chief Standing Counsel and Sri Ajay Kumar, Advocate has put in appearance on behalf of opposite party no.2.
Heard learned counsel for the parties and perused the record.
By means of the present petition, the petitioner is seeking writ of mandamus commanding the opposite parties to implement the advertisement of 72825 Primary Teacher Recruitment, 2012 to qualify the petitioner for participating in the on going 8th counseling for Primary Teacher Recruitment (Primary Level) 2012.
Sri Ajay Kumar, learned counsel for the Basic Education Officer informs that on the basis of instructions that the Primary Teacher Recruitment, 2012 was cancelled by the Special Appeal (Defective) No. 237 of 2013 :Shiv Kumar Pathak and others Vs. State of U.P., therefore, no direction can be issued for taking steps to complete the selection process of the Primary Teacher Recruitment, 2012.
At this stage, learned counsel for the petitioner submits that the petitioner had applied from various places after paying the requisite fee, therefore, opposite parties be directed to refund the fee deposited by the petitioner.
Appreciating the prayer of the learned counsel for the petitioner, the writ petition is disposed of with a liberty to the petitioner to approach the competent authority by means of the raising his grievance for refund of the fee deposited within a period of 15 days from today along with certified copy of the order, if any grievance is raised, the competent authority shall examine and decide the same within a period of 2 months thereafter. The decision so taken shall be communicated to the petitioner.
