*आज मा0 जस्टिस श्री राजेश सिंह चौहान जी की बेंच में टेट मामले की विस्तृत सुनवाई हुई। आज दौराने सुनवाई सचिव श्रीमती सुत्ता सिंह एवम उनके प्रोटेक्टिव एडवोकेट जनरल श्री राघवेंद्र सिंह मौजूद रहे*
कोर्ट ने AG साहब की दलील सुनकर कहा...
*on the request of learned Advocate General, this petition is listed on 26th February, 2018 to enable the State respondent to file better counter-affidavit in conformity with the earlier orders of this Court indicating each facts and circumstances in detail indicating the reasons as to why the guidelines of the State Govt. for conducting examination in question have not been followed strictly.*
【मतलब एडवोकेट जनरल की रिक्वेस्ट पर अब मामले को 26 फरवरी को सुना जाएगा।सरकारी वकील काउंटर दाखिल करके बताये की कोर्ट द्वारा जारी निर्देशो का का अब तक सख्ती से पालन क्यों नही किया?】
इसके बाद कहा.....
*filing counter-affidavit, only a week's time is granted to the State-respondent and copy of the said counter-affidavit be provided to the learned counsel for the petitioners of the leading petition by 22nd February, 2018. If copy of the counter-affidavit is provided to the learned counsel for the petitioners Sri Amit Kumar Singh Bhadoriya, he shall file rejoinder-affidavit by 26th February, 2018.*
【मतलब 1 सप्ताह में(22 फरवरी तक) सरकार काउंटर लगाए। इसकी कॉपी याची के वकील अमित भदौरिया को दी जाए। जिससे वे 26 फरवरी की सुनवाई में अपना रेजॉइंडर लगा सकें।】
इसके बाद कि प्रोसीडिंग में....
*While filing counter-affidavit, the State respondent shall file the relevant documents showing as to when the Expert Committee was constituted in the light of G.O. dated 21st August, 2017 and who were members of that committee. As a matter of fact, the complete report of said Committee would be filed before the Court. Further, the counter affidavit would clearly explain as to why the questions in respect of 'Unseen Passages' which were to be asked in the 'Language Papers' have not been asked as per the guidelines of the Government Order dated 24.12.2014. In Language -I (Hindi) instead of 15 questions, 5 questions have been asked, whereas in Language-II instead of 15 questions, only 3 questions in Sanskrit and 4 questions in Urdu have been asked. In English, only 10 questions have been asked instead of 15 questions.In Writ Petition No.2293 (S/S) of 2018 this anomaly has been mentioned vide paras-22 and 23.*
【अर्थात राज्य एक काउंटर फ़ाइल में ऐसे दस्तावेज लगाए जिसमे ये शो हो कि उन्होंने कमेटी कब बनाई? और उस कमेटी के सदस्य कौन थे?साथ ही साथ उस काउंटर में ये भी स्पष्ट हो कि पाठ्यक्रम के मुताबिक हिंदी,अंग्रेजी,संस्कृत में पैसेज क्यों नही पूछे?】
कोर्ट ने टेट 2017 की प्रत्येक आपत्ति को पूर्ण संज्ञान में ले लिया है। इसके आगे की प्रोसीडिंग में कहा गया.....
*It has been informed by the learned counsel for the petitioners that despite the order being passed by this Court that the authorities concerned shall pass specific order indicating therein that the petitioners before this Court would be permitted to fill up the registration forms if they are found to be eligible for that by 12.02.2018 (vide orders dated 2.2.2018) and by 19.2.2018 (vide order dated 9.2.2018) but no such order has been passed by the authorities concerned. It was expected that the authorities concerned should pass necessary orders in compliance of the orders dated 2.2.2018 and 9.2.2018.It has been informed by the counsel for the parties that the special appeal of the State respondent has been dismissed by the Division Bench of this Court whereby the order of this Court dated 2.2.2018 was challenged, therefore, the authorities concerned must have issued some order indicating therein that the petitioners would be given liberty to fill up the registration forms if they are found eligible for that.*
【याचियों के वकील ने बताया कि कोर्ट के आर्डर के मुताबिक नियामक ने पात्र याचियों को परीक्षा में शामिल करने का कोई आदेश ही नही निकाला।इस याची राहत पर सरकार डबल बेंच गयी। जिस पर उसे राहत नही मिली।इसलिए नियामक ये आदेश जारी करे जिसमे ये दर्ज हो कि जो भी पात्र याची होंगे उन्हें ragistration के लिए पात्र माना जायेगा।】
